What is ADR
Alternative Dispute Resolution (ADR) refers to a range of processes that help parties resolve disputes outside of court — faster, more affordably, and with greater confidentiality.
A neutral arbitrator hears both parties and issues a binding order — final, conclusive, and legally enforceable like a court judgment. Once an arbitration order is issued, it is binding on all parties and cannot be easily appealed or overturned. Faster, private, and far less expensive than litigation. The preferred method for complex construction disputes.
A neutral mediator facilitates structured negotiation between parties, guiding them toward mutual understanding and a mutually agreed settlement. The process encourages open dialogue, helping each party understand the other's position before reaching a resolution. Non-binding until agreement is signed.
A hybrid process that begins with mediation — giving parties the opportunity to reach a mutual agreement through open dialogue. If mediation does not resolve the dispute, the process transitions to binding arbitration, where the arbitrator issues a final, enforceable order.
